Please read these Terms and Conditions of Use ("Terms") carefully. By registering for, accessing, or using the "MERAAPNADOCC" web-based application (the "Application" or "Service"), you agree to be bound by these Terms and all policies incorporated by reference. If you do not agree to these Terms, you may not use the Application.
1. DEFINITIONS AND ACCEPTANCE
1.1. Definitions
- "Application" refers to the "MERAAPNADOCC" web-based software platform.
- "User" refers collectively to Doctors, Patients, and the Admin.
- "Doctor" refers to a duly registered medical professional user of the Application.
- "Patient" refers to the end-user seeking consultation via the Application.
- "Consultation Fee" refers to the small fee set by the Doctor, payable by the Patient prior to a consultation.
- "Subscription Fee" refers to the recurring payment made by the Doctor for continued access to the Service.
1.2. Acceptance of Terms
These Terms constitute a legally binding agreement between YOU [the User] and MERAAPNADOCC.IN Owner, [hereinafter "Service Provider"]. Your continued use of the Application signifies your acceptance of any subsequent revisions to these Terms.
2. DESCRIPTION OF SERVICE
The Application functions solely as an intermediary technological interface to facilitate non-emergency, telephonic communication between a Patient and their selected Doctor. It is explicitly managed through three separate panels: the Admin Panel, the Doctor Panel, and the Patient Panel. The service is provided on an "always logged in" basis for Patients and a managed subscription basis for Doctors.
3. DOCTOR ACCOUNTS AND FINANCIAL OBLIGATIONS
3.1. Registration and Onboarding
To register as a Doctor, you must provide accurate identifying information (Name, Age, Sex, Phone Number) and accept these Terms.
- After a free trial period of 30days upon initial registration.
3.2. Subscription and Payment
Continued access to the Service requires payment of a recurring Subscription Fee, which is fixed according to the selected term:
- 3 Months: ₹1,500
- 6 Months: ₹3,000
- 12 Months: ₹6,000
- All fees (Onboarding and Subscription) must be remitted via the Unified Payments Interface (UPI) as designated by the Service Provider.
3.3. Subscription Renewal and Suspension
- The Doctor will receive renewal reminders 15 days TO 29 days prior to the Subscription Fee due date.
- A 15-day grace period is permitted following the due date, during which the Doctor may continue to use the Application.
- If the Subscription Fee remains unpaid after the 29-day grace period, the Doctor's access will remain suspended, and the Application will display a mandatory "Please Renew Subscription" window until payment is successfully processed.
3.4. Consultation Fee Setting Doctors shall set a small, self-determined fee (defaulting to ₹101) for phone consultations facilitated by the Application. This fee is handled by the Application on behalf of the Doctor and is intended to ensure the value of advice is maintained and the Doctor's self-respect is upheld. The Application is not designed to be a "money-making app" for the doctor.
4. PATIENT REGISTRATION AND CONSULTATION PROCESS
4.1. Access and Registration Patient access is initiated via an invitation link sent by a Doctor. Registration requires the Patient to submit: Name, Age, Sex, and WhatsApp Phone Number.
4.2. Consultation Fee Payment
- The Patient is required to pay the Doctor’s set Consultation Fee prior to the consultation.
- This payment is processed via a clickable UPI gateway displayed on the payment screen.
- The Service Provider is not a party to this fee; it is a direct transaction for the Doctor's time and knowledge.
4.3. Data Submission The Patient may optionally submit textual medical/ disease related complaints and is required to upload relevant media, documents, or PDFs. The Patient is solely responsible for the accuracy and legality of all submitted data.
5. MEDICAL DISCLAIMER AND LIMITATION OF LIABILITY
5.1. No Fiduciary or Healthcare Relationship: The Application is not a healthcare provider, insurer, or pharmacy. The Service Provider does not employ or endorse any Doctor. The relationship established during a consultation is strictly between the Doctor and the Patient, and the Service Provider acts solely as a technical intermediary.
5.2. Express Disclaimer of Medical Liability: The Service Provider expressly disclaims all responsibility and liability for:
- The quality, accuracy, efficacy, or outcome of any advice, diagnosis, treatment, or prescription provided by the Doctor.
- Any injury, adverse effect, loss, or damage arising directly or indirectly from the Patient's reliance on the consultation.
- The Doctor's professional conduct, licensing, and compliance with medical standards and ethics.
5.3. Medico-Legal Exclusion: The Consultation, including any resulting diagnosis or prescription provided through the Application, is intended for personal reference and advisory purposes only. It shall not be used or considered admissible for any medical-legal, official certification, insurance claim, or litigation purposes whatsoever.
5.4. Doctor's Sole Responsibility The Doctor warrants that they are solely responsible for:
- All professional decisions and services rendered to the Patient.
- Maintaining appropriate licensure and professional insurance.
- Adhering to all applicable medical laws and regulations.
- The Application does not support, deny, endorse, or validate any reviews or opinions regarding the Doctor's dealings with the Patient.
5.5. Indemnification The User (both Doctor and Patient) agrees to indemnify, defend, and hold harmless the Service Provider, its affiliates, directors, agents, and employees from any and all claims, liabilities, costs, or damages (including legal fees) arising from the User's use of the Application, reliance on medical advice obtained through the Application, or any breach of these Terms.
6. DATA AND ACCOUNT MANAGEMENT
6.1. Admin Panel Rights The Admin Panel possesses broad administrative rights, which include the acknowledged right to:
- View, edit, and delete any Doctor or Patient account.
- View and check Doctor payment history.
- Search Patient data by Phone Number.
- Export Patient data in an Excel format.
6.2. Data Retention and Deletion
- Patient registration data remains stored for account recognition.
- Consultation-specific data (complaints, uploaded files) will be archived as when the Doctor marks the consultation as "Consult Complete (Yes/Close and Delete)."
- If a consultation is left "Open (No)," the associated data remains active on the Doctor's dashboard.
6.3. User Account Deletion
- Doctors may initiate account deletion via the "My Account" option.
- Patients do not have the ability to delete their account via the Patient Panel. Account deletion must be requested via the Admin Panel.
7. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of jurisdiction of India, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located within Bhubaneswar to resolve any legal matter arising from these Terms.
